Welcome to Power X Tools & Machinery (“Power X Tools & Machinery”, “we”, “our”, “us”). These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy, Return & Refund Policy, Shipping & Delivery Policy.

If you do not agree, do not use the Services.

1) Eligibility & Accounts

  • You must be at least 18 years old or use the Services under the supervision of a parent/guardian.
  • You’re responsible for the accuracy of information you provide and for maintaining the confidentiality of your account credentials.
  • We may refuse service, close accounts, or cancel orders where we suspect misuse, fraud, or policy breaches.

2) Orders, Acceptance & Availability

  • All orders are offers to purchase and are subject to acceptance by us. We may decline or cancel any order (e.g., due to stock errors, pricing issues, or risk flags).
  • We strive for accurate listings, but availability is not guaranteed. If an item is unavailable, we’ll contact you with options (back-order, alternative, refund).

3) Pricing, Taxes & Errors

  • Prices are shown in Kenyan Shillings (KSh) unless stated otherwise and may change without notice.
  • Display or typographical errors may occur. We may correct errors and cancel affected orders before dispatch.
  • Taxes/levies (if applicable) are added at checkout.

4) Payments

Accepted methods include M-Pesa, card/bank/wallets (where supported), and Cash on Delivery (COD) for eligible orders and locations.

  • For COD, limits and location coverage apply; we may require full or partial prepayment for high-value or special-order items.
  • We may use automated or manual checks to prevent fraud. We can cancel or hold orders pending verification.
  • By submitting payment information, you represent that you’re authorized to use the selected method and authorize us (and our payment processors) to charge the full amount and applicable fees.

5) Shipping, Delivery & Risk of Loss

  • We ship Kenya-wide via trusted couriers/freight partners. Shipping options, timelines, and fees are shown at checkout or quoted for bulky items.
  • Title and risk of loss pass to you upon delivery to your address/collection point. Please inspect deliveries on arrival and report issues within 48 hours (see Return Policy).

6) Returns, Refunds & Exchanges

  • Returns are accepted per our published windows and conditions.
  • Refunds are processed to the original payment method where possible.
  • Some items are non-returnable (e.g., used wear parts, custom-cut items, opened electronics).

7) Warranties & Service

  • Many products carry a manufacturer warranty (typically 6–12 months unless stated otherwise). Warranty remedies are usually repair, replacement, or parts per the brand’s terms after inspection.
  • Installation for solar/electrical items must be by a qualified technician. Petrol/diesel equipment must be fueled, oiled, and maintained correctly.

8) Product Information, Safety & Professional Use

  • Tools and machinery can be hazardous if used improperly. Always read manuals, follow safety guidance, and wear appropriate PPE.
  • Images are illustrative; minor variations in packaging or model revisions may occur.
  • Solar/electrical items: incorrect wiring, reverse polarity, overloading, or environmental damage is not a manufacturing defect.
  • Petrol/diesel equipment: running without oil, contaminated fuel, or lack of maintenance voids coverage.

9) Prohibited Uses

You agree not to use the Services for unlawful purposes; to infringe IP rights; to transmit malware; to bypass security; to scrape our content without permission; or to abuse, harass, or interfere with the site, our staff, or other users.

10) User Content & Reviews

If you submit reviews, photos, or comments (“User Content”), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with the Services and our marketing. You confirm you own or control the rights to your content and that it is accurate, lawful, and non-misleading.

11) Intellectual Property

All site content (text, graphics, logos, product listings, photos) is owned by us or our licensors and protected by applicable laws. You may not copy, reproduce, or exploit content without prior written consent.

12) Third-Party Services & Links

We may link to third-party sites or use third-party tools (e.g., payment processors, couriers). We’re not responsible for third-party content, policies, or actions. Use them at your own risk and review their terms.

13) Promotions, Coupons & Gift Cards

  • Promotions/coupons may be single-use, non-transferable, and time-limited.
  • We may modify or end promotions at any time.
  • Gift cards/store credit are redeemable only through our store, are not cash-redeemable, and may have validity limits per Kenyan law.

14) Limitation of Liability

To the maximum extent permitted by law, Power X Tools & Machinery will not be liable for any indirect, incidental, special, consequential, or punitive damages, loss of profits, data, business, or goodwill. Our total liability for any claim related to the Services shall not exceed the amount you paid for the product(s) giving rise to the claim in the 6 months preceding the event.

15) Disclaimers

Except as expressly provided, the Services and all information are provided “as is” and “as available”. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by Kenyan law.

16) Force Majeure

We are not responsible for delays or failures due to events beyond our reasonable control, including acts of God, weather, strikes, wars, regulatory actions, power failures, internet outages, or courier disruptions.

17) Termination

We may suspend or terminate your access to the Services at any time for any reason (including suspected misconduct). Sections that by nature should survive termination will survive (e.g., IP, disclaimers, limitations of liability).

18) Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Kenya. You agree to the exclusive jurisdiction of the courts of Nairobi, Kenya for any disputes arising out of or related to the Services.

19) Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on our website with the “Last updated” date. Your continued use of the Services after changes means you accept the updated Terms.
